We had a sales representative come to our home to discuss purchasing and installation of a roof. We finally agreed on a style and wrote out a $1000 check as a deposit. When the loan failed to go through we questioned whether this was the right time to be doing business. The lender had no problem with our credit. The loan was denied because the lender would not lend more than $10,000 in this tight economy. We needed $20,000. I told the rep that I would check with our credit union to see what we could do, and would get with him on Monday. The rep insisted he would work with another company but, he didn't like using this particular company because of the high interest rates (13.99%). We told the rep this interest rate was too high, and we would check to see if the Credit Union rates were lower before going ahead with this deal. The rep said "okay", then we called it a night. I checked with our credit union the next day. They told me they were not making loans for more than $10,000. The whole thing seemed futile, so we exercised our right to cancel the deal within 3 business days. I called the Project coordinator and informed him of our decision. He told me he would call the office but I needed to inform the sales rep as well. I called the rep twice, but he did not answer his phone. I left messages each time I called explaining that we would wait until credit frees up before getting a new roof. I told him we were canceling the deal. I also sent a FAX to the company headquarters in Sacramento telling them we were canceling the deal until the economy got better. I called the Project coordinator a second time to inform him about the FAX and the messages left with the Sales Rep. Nothing was happening. So, we sent a text message to the Sales rep on the last day of the contractual 3 business day release time. We told him again of our decision and that we wanted our $1000 check returned. He sent a message back immediately saying "No problem". This was all done between the dates of April 3, 2009 and April 7, 2009. There was a weekend in between. We went on a short vacation and returned to find the check had not been sent back to us. In fact, it had been deposited into the Quality First account. It was posted by my bank on April 7, which means it was probably deposited on April 6. I immediately called the Project coordinator and he told me he would call the main office and get our money returned. We sent a text message to the sales rep, but has not responded. The problem is we were upfront about the high interest rates and lack of funding for loans over $10,000. We canceled the project within the legal limits and informed all parties involved. The check was deposited by Quality first even after we canceled, and it was deposited BEFORE the legal 3 day cancellation period. On top of that, the sales rep told us "No problem" when we asked for our check back even though he knew the check had already been deposited. This company should have never cashed our check. This company should have canceled the deal when we canceled the deal.
